VEDAMO, Inc. (“TUTOR.ONE (VEDAMO)”, “we”, “us” or “our”) owns and operates tutor.one and any and all associated domains, the Platforms, and applications (collectively “the Platform”, “TUTOR.ONE Platform”). Any reference to TUTOR.ONE (VEDAMO) includes TUTOR.ONE (VEDAMO)'s affiliates and other authorized representatives.

This Privacy Policy applies to all users and visitors who access, use, and interact with the Platform (collectively “you” or “your”) and describes what, how, and when we collect, use, disclose, and safeguard your information.

TUTOR.ONE (VEDAMO) is GDPR, FERPA and COPPA compliant.

PLEASE READ THIS PRIVACY POLICY CAREFULLY BEFORE USING THE TUTOR.ONE PLATFORM.

By accessing, using, and interacting (collectively “Use,” “Uses,” or “Using”) with the Platform, you agree and accept this Privacy Policy and our General Terms and Conditions. Any reference to Platform in this Privacy Policy shall also mean the products, services, features, and content offered on or through the Platform. For the purposes of this document the definitions of the General Terms and Conditions apply.

1. WHAT INFORMATION DO WE COLLECT?

There are three general categories of information that we may collect: information you give us, information we automatically collect, and information we collect from third parties. TUTOR.ONE (VEDAMO) collects (i) aggregated information by which it is not possible for a particular Learner/ Tutor to be identified (such sort of information is time zone, the connection speed, network connection data, and so on) and (ii) personally identifiable information, which is information that can be used to identify a specific individual. We may use the provided personal information in order to respond to your inquiries, to provide specific services that you have selected, or to send you marketing communication after being granted your explicit consent.

1.1 Information You Give Us

We collect certain information that you may share with us when you Use the Platform. We do not collect any personally identifiable information unless it is voluntarily submitted by you. Such information includes:

  • Account Information.
    We may collect your personally identifiable information when you sign up and create an account on the Platform, including your full name, email address, password, phone number, location, biography, education, photo, and other pertinent account information. We use this information to establish and service your account, fulfill your requests on the Platform, and send you account-related notifications and announcements.
  • Payment Information.
    • For Learners: We provide you with the opportunity to pay our services with debit and credit cards through a payment service provider. Please note that only the payment service provider collects and processes the full information from your debit and credit cards. We don't store your debit or credit card information.
    • For Tutors: We provide you with the opportunity to payout your fees through a payment service provider. Please note that only the payment service provider collects and processes your full financial information.
  • Communications.
    When you contact us or communicate with us through the Platform, email, or other methods of inquiry, or Use the Platform to communicate with other users, we collect information you provide in your communications, including video recordings and chat transcripts. We use this information to fulfill and/or respond to your communications and requests, keep you informed about the Platform, and to optimize it.
  • Other Information.
    You may choose to provide us other information when Using the Platform, including your lesson requests, homework and other documents that you submit for review, response to surveys or questionnaires provided by us, and ratings of other users you interact with on the Platform.

By providing this information, you do so at your own discretion and risk and authorize us to collect, use, disclose, and store the information in accordance with this Privacy Policy and applicable law. While you may be able to Use the Platform anonymously on a limited basis and choose not to provide us with personally identifiable information, this will prevent you from Using the Platform fully and functionally.

1.2 Information We Automatically Collect

We may automatically collect certain information whenever you Use the Platform or interact with us, including:

  • Usage Information.
    We collect information about your Use of the Platform, such as the date you created an account on the Platform, the date(s) and time(s) you Use the Platform, the length of time that you spend on the Platform, actions you take on the Platform, including lessons that you've started and completed, and the pages or content you view on, before, or after the Platform, including links to third party the Platforms and applications.
  • Log Data.
    We may maintain web server logs and automatically collect log information when you Use the Platform, even if you do not have an account with us. Log data includes IP addresses, geolocation, hardware and software information, device information, operating system, browser type, device event information (e.g., crashes), and internet service provider or mobile carrier. Log data may be purged periodically at any time.
  • Transaction Information.
    We collect information related to your payments and transactions on the Platform, including the date and time of transactions, amounts charged, and other related details.

1.3 Information We Collect from Third Parties

To the extent permitted by applicable law and in accordance with this Privacy Policy, we may collect information about you from public or other third party sources as it may be pertinent to your Use of the Platform.

2. HOW WE COLLECT INFORMATION

In addition to collecting information that is directly submitted by you on the Platform, we may collect information using other methods such as cookies, including session cookies, local storage, and pixel tags. Additionally, we may utilize a third party vendor on our behalf to perform these collection practices.

While most browsers accept cookies and local storage by default, you may change and disable the use of cookies and local storage through your browser settings. Changing or disabling any cookies or local storage will affect how you Use the Platform and your overall experience on the Platform.

3. HOW WE USE THE INFORMATION WE COLLECT

We will only use your information as described below. We do not sell or lease any personally identifiable information, including financial and billing information, to third parties for purposes of marketing or solicitation without your consent.

3.1 Disclosure to Other the Platform Users

When you Use the Platform, you may choose to disclose and display certain information to, and communicate, interact, and transact with, other users on the Platform. You will also have access to information disclosed and displayed by other users on the Platform.

3.2 Limited Disclosure to Third Parties

We do not allow third parties to collect your personal, financial, or other sensitive personally identifiable information. However, we reserve the right to disclose certain information to third parties in limited circumstances, at our sole discretion and without further notice to you, if it is deemed necessary and in accordance with this Privacy Policy, our General Terms and Conditions, and applicable law, including the following circumstances:

  • To safeguard, deter, and investigate against illegal, fraudulent, or unauthorized use of the Platform;
  • To protect and maintain the safety of you, us, others, and related property when necessary;
  • When there is a change of control or ownership of all or part of VEDAMO Inc., including sale, transfer, merger, acquisition, reorganization, bankruptcy, dissolution, or other similar event;
  • To establish and enforce our legal rights and rights under this Privacy Policy, our General Terms and Conditions, and any agreements and policies we are a party to;
  • To complete any transaction initiated by you on the Platform;
  • To provide certain products, services, features, and content to you on the Platform;
  • To facilitate the operation and management of the Platform;
  • As required by law, compelled by subpoena or court order, or in connection with any ongoing or prospective legal proceedings;
  • With your express written consent; and
  • As otherwise described or permitted in this Privacy Policy, our General Terms and Conditions, and applicable law.

If any personally identifiable information is disclosed to a third party, the third party shall maintain the confidentiality of such information and is prohibited from using it for any purpose except as permitted by us and in accordance with this Privacy Policy.

We may disclose any and all information that is not personally identifiable information to our partners, advertisers, and other third parties for any reason at our sole discretion and without further notice to you, including Google Universal Analytics, Google Analytics, and Google Display Advertising. Additionally, we may share information with social networking services if you use such services to Use the Platform to the extent permitted by the privacy agreement with the social networking service and in accordance with this Privacy Policy.

3.3 Internal Use

We may use the information we collect for internal use in accordance with this Privacy Policy, our General Terms and Conditions, and applicable law, including:

  • For research and development to personalize and improve the Platform, and the products, services, features, and content we provide through the Platform, and to enhance the user experience, including researching user demographics and behavior;
  • To respond to your requests, inquiries, and complaints, provide you with technical and customer support, and solicit and receive feedback from you related to your Use of the Platform;
  • For standard business practices and purposes including system administration, troubleshooting, establishing and managing accounts, creating and maintaining a database of information collected on the Platform;
  • To safeguard, deter, and investigate against illegal, fraudulent, or unauthorized Use of the Platform;
  • To verify compliance with this Privacy Policy, our General Terms and Conditions, any agreements entered into between you and us, and applicable law;
  • To contact you directly for non-marketing purposes including providing you with statements, invoices, confirmations, notifications, surveys, technical updates, security alerts, and administrative messages; and
  • To contact you directly for marketing purposes including providing you with announcements and updates regarding our business and to inform you of new products, services, features, and content.

You acknowledge and agree that all non-personally identifiable information or data, such as requests, comments, suggestions, and feedback, that are provided to us in any manner by you is nonconfidential. To the extent permitted by applicable law, you grant us, or anyone authorized by us, a non-exclusive, unrestricted, irrevocable, perpetual, royalty-free, and worldwide license to use, distribute, display, modify, reproduce, transmit, perform, and broadcast derivative works of such information or data, in whole or in part, and in any manner or medium, at no cost whatsoever.

4. THIRD-PARTY the Platforms

The Platform may contain links to or display content from other websites or applications that are owned, operated, or controlled by unaffiliated third parties that may collect information about you, including social media platforms. This Privacy Policy is only applicable to the Platform and not to any such websites or applications of any third parties, which may have data collection and privacy practices and policies that differ materially from this Privacy Policy or our Terms of Service. We do not review, monitor, approve, endorse, warrant, or take responsibility for such third party websites or applications and do not make any warranties or representations regarding such websites or applications and any resulting privacy policies or data collection practices. Once you leave the Platform, you are subject to the terms of use and privacy policies of other third party websites or applications. You access, use, and interact with these websites and applications at your own risk and are encouraged to do so with caution. We recommend that you review the privacy policies for each website or application you access, use, and interact with to understand how personally identifiable information is collected, used, disclosed, and stored. You expressly waive and release us from any and all liability arising from your access to, use of, and interaction with any third party owned and operated websites or application.

4.1 Google Calendar Integration

TUTOR.ONE uses and transfers to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

5. SECURITY

We implement physical and technical security measures commercially reasonable and necessary to protect the information we collect from you from unauthorized access, use, alteration, disclosure, or destruction of such information. However, we cannot guarantee these safeguards are absolutely secure and that any personally identifiable information will remain free from unauthorized access, misuse, alteration, disclosure, or destruction by third parties. Should we learn of a potential or actual security breach that puts your information at risk of unauthorized access, use, alteration, disclosure, or destruction, we may notify you so you can take appropriate next steps to protect and remedy the situation. However, we are not liable or responsible for any of your information that is intercepted and used by an unintended third party recipient.

As a preventative measure, we advise that you take precaution in handling sensitive or confidential information when providing such information on or through the Platform or insecure online methods of communication.

6. INTERNATIONAL USE AND DATA TRANSFER

The Platform is maintained and hosted by a web server located in the United States. It is operated in accordance with the laws of any other country. If you are located in and Using the Platform from a non-U.S. jurisdiction and voluntarily provide personally identifiable information to us, or we automatically collect certain information about you, such information will be transferred and processed in the U.S. By Using the Platform and consenting to this Privacy Policy, you agree to such transfer and acknowledge that data protection may differ from your home country or the country from which you are Using the Platform.

7. DATA RETENTION

We will retain your information for as long as your account (i) is active, (ii) for a commercially reasonable time by us for administrative, liability, and archival purposes, or (iii) to comply with our legal obligations, resolve disputes, and enforce our agreements.

8. USER RIGHTS

TUTOR.ONE (VEDAMO) stores personal data for Learners and Tutors for as long as is necessary to answer queries or resolve problems, provide improved and new services, and comply with legal requirements under applicable laws. To meet our tax and accounting obligations, data about a Learner/ Tutor is retained for a period of 11 years from the termination of their last contract. Upon the expiration of the deadlines for the processing of personal data, the data is anonymized or deleted/destroyed unless:

  • The relevant Learner/ Tutor has exercised their right to request the limitation of the processing of personal data relating to them.

Learners and Tutors have access to their personal information and can confirm that they are correct and up-to-date, as well as whether or not to receive materials from us or our partners through our Platform by visiting their profile. They can also contact us at support@tutor.one. We strive to respond promptly to each email, but it is possible that there might be exceptions. Keep in mind that we store residual information in our databases, access registers, and other arrays, and this information may or may not contain your personal information. If you have questions about privacy, unresolved issues, or complaints, you can contact us at support@tutor.one.

Learners and Tutors have the following rights:

  1. The right to access the personal data relating to them:
    • Learners and Tutors are entitled to obtain information from TUTOR.ONE (VEDAMO) on whether personal data relating to them is being processed. If so, Learners and Tutors have the right to access the relevant data.
  2. The right to correct the personal data they submit when it is inaccurate or out of date:
    • If the personal information processed by TUTOR.ONE (VEDAMO) is inaccurate or outdated, Learners and Tutors are entitled to correct and update it.
  3. In some cases, Learners and Tutors may request the deletion of personal data when:
    • Personal information is no longer necessary for the purposes for which it was collected or processed.
    • The Learner or the Tutor has withdrawn their consent to the processing of personal data and there is no other legal basis for the processing of the same.
    • The Learner or the Tutor has the right to withdraw their consent to the processing of their personal data for the purpose of marketing without limiting their right to use the services provided by TUTOR.ONE (VEDAMO).
  4. The right to data portability:
    • Learners and Tutors have the right to obtain from TUTOR.ONE (VEDAMO) the personal information that they submitted (such as the data provided when registering); this information shall be provided to the Learner or the Tutor in an organized, orderly, structured, and generally accepted electronic format (for example, in a .csv file).
  5. The right to appeal:
    • If a Learner or a Tutor considers that TUTOR.ONE (VEDAMO) is violating any applicable legal regulations, it is advisable to initially alert TUTOR.ONE (VEDAMO). If adequate measures are not taken by the TUTOR.ONE (VEDAMO), the Learner or the Tutor has the right to file a complaint with the competent authority.

9. PRIVACY POLICY UPDATES

We reserve the right to update this Privacy Policy at any time, at our sole discretion and without further notice to you, from time to time. Updates to this Privacy Policy will be posted on the Platform and go into effect on its specified Effective Date. Please check the Platform periodically when Using the Platform to keep up-to-date on any changes to this Privacy Policy. Your continued use of the Platform constitutes your acknowledgment and acceptance of this Privacy Policy and any updates made to it. If you do not agree with any of the current or future provisions of this Privacy Policy, you shall not Use, or continue to Use, the Platform.

10. TERMS OF SERVICE

Any dispute between you and us regarding the privacy of your information is subject to this Privacy Policy and our General Terms and Conditions, including limitation on damages, dispute resolution, and applicable law.

We cannot guarantee receipt of any correspondence, including mail, messages, and emails, sent to us; thus, receipt of any correspondence is not confirmed until and unless you receive a written response from a TUTOR.ONE (VEDAMO) representative confirming such receipt. We are not liable for any correspondence that is lost, delayed, or misdirected.
